Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DefenderMon service, including the defendermon.com website and the DefenderMon agent software (together, the "Service"), operated by Bitnax Inc. ("Bitnax", "we", "us"). By creating an account or installing the agent, you agree to these Terms.

1. The Service

DefenderMon provides remote monitoring and management for Microsoft Defender and Windows Update on devices you enroll. The Service manages features built into the Windows operating system; it is not a replacement antivirus engine. DefenderMon is an independent product of Bitnax Inc. and is not affiliated with, sponsored, or endorsed by Microsoft Corporation.

2. Accounts and eligibility

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. You may only enroll devices you own or are authorized to manage.

3. Plans, billing, and cancellation

New accounts include a 30-day free trial with unlimited devices and no payment details required. When the trial ends, the dashboard is locked and your devices stop being monitored a short time afterwards. Nothing is deleted at that point: your data is retained so that subscribing restores the account as it was, and the agent remains installed on your devices until you remove it.

The Pro plan is billed annually in advance at the price shown at checkout and supports unlimited devices. Fees are non-refundable, including for partial periods and for periods during which the Service was not used, except where a refund is required by law. The 30-day trial exists so that you can evaluate the Service fully before paying.

You may cancel at any time from your account settings. Cancelling stops the next renewal; your subscription continues until the end of the period you have already paid for, and the account is not downgraded before then. We may change pricing with at least 30 days' notice, and a change never affects a period you have already paid for.

You can delete your account and all associated data at any time from your profile. If an account remains expired for an extended period we may delete it and its data, and we will email you before doing so.

4. Acceptable use

You agree not to use the Service to violate any law, interfere with the Service's operation, attempt unauthorized access to systems or data, resell the Service without our written consent, or deploy the agent to devices without proper authorization.

5. Agent software license

We grant you a limited, non-exclusive, non-transferable license to install and use the DefenderMon agent on enrolled devices for the duration of your subscription. You may not reverse engineer, modify, or redistribute the agent except as permitted by law.

6. Your responsibilities

The Service is a management tool. You remain responsible for your devices, your security configuration, and the actions you take through the dashboard — including scan schedules, exclusions, policies, and update deployments. Test policies and updates appropriately before broad rollout.

7. Availability and support

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Pro subscribers receive priority support. We may modify or discontinue features with reasonable notice.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL DETECT OR PREVENT ALL THREATS OR THAT ALL UPDATES WILL INSTALL SUCCESSFULLY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITNAX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data is deleted in accordance with our Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via the dashboard or email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
